The following is from Judicial Watch.

In a major legal victory for transparency, a Georgia court entered a default judgment against Fulton County District Attorney Fani Willis, ordering her to release communications with Special Counsel Jack Smith and the House January 6 Committee. The lawsuit, filed by watchdog group Judicial Watch, accused Willis of violating Georgia’s Open Records Act by failing to provide requested records or respond in court.

The court found Willis in default, noting she failed to file an answer or provide any defense. Willis is now required to produce the documents within five business days and follow legal procedures if she intends to withhold any.

“This is the first time in our experience a government official has been found in default for not showing up in court to answer an open records lawsuit.”

Tom Fitton, President, Judicial Watch

The lawsuit stems from a March 2024 filing under Georgia’s Open Records Act. Judicial Watch alleged that Willis ignored an August 2023 records request for documents related to her communications with key players in her Trump-related prosecutions. The court’s ruling not only highlights Willis’s lack of compliance with transparency laws but also raises questions about her handling of politically charged cases.

Judicial Watch contends the requested documents could reveal collaboration between Willis, the Biden administration, and the January 6 Committee to target Trump. A letter cited in the case showed that Willis had previously sought assistance from the January 6 Committee, offering to meet in Washington, D.C., for collaboration. These communications could provide insight into the motivations behind her controversial prosecution efforts.

The court also granted Judicial Watch’s request for attorneys’ fees, with a hearing set for December 20. This case is part of Judicial Watch’s broader campaign to expose abuses of power in politically motivated prosecutions.

“These cases highlight the need to hold public officials accountable, especially when their actions impact the integrity of our justice system.”
